Tennessee consumers can have wine shipped directly to their homes under a new law signed by Gov. Phil Bredesen. The law allows wineries that acquire a $300 license to ship up to three cases to Tennessee consumers per year.

Congrats!

Paying sales tax is probably a lot less hassle and $$ than double shipping. Or driving to other states to pick up wine as some were doing.

Only three cases a year? Yikes. Looks like stemor will still have to smuggle in his Kistler!

He has a wife that he can ship to so that will probably cover most of his order. I'm certain that some of his MO trips will continue.

How many wineries will pay the $300 to ship there?

I know ND has a similar law and a lot of wineries no longer ship here because of it.

According to what has been reported (I have not read the full ruling yet), the bill requires out-of-state wineries to obtain a $300 non-refundable application fee and $150 annual permit fee. What the bill doesn't say is if the $150 permit fee covers all labels from the brand or if they require each label to be registered individually @ $150 each. That would be a "hit" for small producers if it is $150 for each label per year.

Chilly - you are probably right that some will pass on shipping to TN customers. We're already looking into what we need to do to register as we have several loyal mailing list members who live in Tennessee and we would gladly pay the fees to make it more convenient to ship to them.

That is good to hear. QC and KB both dropped ND, but I was their only customer. Luckily I live on the border of Minnesota and it's just as easy to ship to friends in that state.

I thought the $300 fee sounded high, so I looked at what Texas charges for a Direct Shippers permit. It looks like the statuatory fee is $150, but it also looks like the Texas ABC tacks on a $320 surcharge ?!? I think this is an annual fee, although the permits are now for 2 years. A winery has to have a fair number of customers in state before it makes sense to spend $1000+ before shipping a single bottle.

ShaferGuy, I was looking forward to shipping to Carol ... and also Reese, Ashley, and Shelby (those all sound like people, right?  And in dog/cat years, I suppose all are of legal drinking age). 
 
Jimmy, you raise a good point re: Kistler, at least in reference to past years.  Fortunately, they cured me of my desire to purchase from them with their handling of the Spring 2009 allocation.
 
As for paying our 9.25% sales tax on wines shipped to Tennessee, I can't see me shipping anything more expensive than, say, Le Cadeau directly to my home address.  Other items (like Quilceda Creek, for example) would likely need to ship to a more ... "tax advantageous" address.

On Friday, June 12th, Governor Baldacci signed LD 1008 - our little direct wine shipping bill -- it is now Maine Public Law Chapter 373. Oh yes!!!

Our thanks go out to all of the members of the Joint Committee on Legal and Veterans affairs who voted “ought to pass.” Their careful consideration of our case made the process one real Mainers felt a part of.

We’re especially grateful to:

Rep. Stacey Fitts – Rep Fitts was our champion on the committee. He was the person who kept our cause moving through the process.

Carol Martel and Deb Hart from the Wine Institute – Their understanding of the issue and keen ability to negotiate pushed us over the line.

Rep. Lindell and Sen. Bromley – Their work in prior sessions cleared the path for our efforts this time around.

To all of the Mainers who wrote in and told their representatives “Now is the time for Maine to pass direct shipping legislation!”

Finally, our greatest ally of all was Rep. Melissa Innes. As the bill’s sponsor, Rep. Innes did an astounding job articulating the merits of our bill and gathering the support necessary to finally get this bill passed.
 

Now I can send wine to myself for vacation, or for family gifts, without having to check it as luggage.  I might even be able to figure out how to take advantage of my octogenarian parents' cool cellar, though I hate the image of Mom  lugging cases of wine down stairs (but I don't hate it so much that I won't at least consider it)  :-)
